California Employers Must Pay for Food Handler Training: What SB 476 Means for Your Business
California SB 476 shifted the financial responsibility for required food handler training from employees to employers. Here is what hospitality businesses need to know—and how LIQUORexam.com can make employee training more affordable and easier to manage.
What Is California SB 476?
Senate Bill 476 changed California’s food handler training requirements beginning January 1, 2024. Although many California food employees were already required to obtain a food handler card, the new law changed who is financially responsible for obtaining it.
Under SB 476, covered employers—not their employees—are responsible for the costs associated with required food handler training and testing.
Employers should review their onboarding and reimbursement procedures to make sure employees are not being required to purchase mandatory food handler training with their own money.
What Must California Employers Pay For?
California employers covered by the food handler requirements should account for more than the advertised price of a training course. The employer’s total obligation may include both direct training expenses and employee labor costs.
Employees must also be relieved of their other work duties while completing the required training course and examination. In practical terms, an employee should not be expected to complete the course while simultaneously serving customers, preparing food, answering phones, or performing other assigned duties.
Employers Cannot Simply Require Applicants to Arrive Certified
An employer should not attempt to avoid the requirements of SB 476 by making an existing food handler card a condition of employment. Businesses need an onboarding process that allows newly hired employees to complete the required training at the employer’s expense.
This makes an organized training process especially important for restaurants, hotels, bars, catering companies, concession operators, hospitality staffing agencies, and other businesses that regularly hire food service employees.
The True Cost Is More Than the Course Price
Employers often focus only on the price of the food handler course. Under SB 476, however, the total cost also includes the wages paid while the employee completes the training and examination.
This is why choosing an efficient training provider matters. A course that is difficult to access, poorly optimized for mobile devices, or filled with unnecessary delays may cost the employer far more in wages than the original course price.
